IN THE PREVAILING POLICE SYSTEM YOU DO NOT ALWAYS HAVE THE POSSBILITY TO ASSERT YOUR RIGHTS.
That is why it is important for you to know how you could react.
It can quickly happen that you are in the wrong place at the wrong time, that the police discriminate against you or humiliate you, that you try to protect people from the police or the police wants anything else from you
IDENTITY CHECK
There is always a possibility, so always carry an identity card with you. Otherwise, in the worst case, you will have to go to the police station.
You must provide the following information:
- First name, last name
- Address of registration
- Date of birth
You do not have to give any further information, so also no cell phone number.
SEARCHINGS / RAIDS
- The police may search your luggage if they suspect a criminal offense. Ask what the crime is, the police are (actually) required to tell you.
- You have the right to keep your clothes on and not to strip down to your underpants in public.
- Your pockets may be emptied and scanned.
- While the Police is scanning you, your privacy must be respected.
- Insist that you be searched as a woman by a woman and as a man by a man.
- Non-binary people are especially vulnerable because police officers only know the binary gender of women and men. Police may ignore your specific wishes. Ask for a female/male police officer to search you, if you have the energy to ask for it. Help a friend in a situation of searching and intervene if necessary.
IN CUSTODY / POLICE STATION
- While you are at the police station (before being transferred to jail) you are allowed to make a successful call. The good way is to call the antirep number or a good friend.
- The police can detain you for max. 24 hours and 48 hours with the extension through detention judgment. (HAFTRICHTERLICH)
- After that they have to bring you before an examining magistrate.
- You have the right to ask for a lawyer at any time.
IDENTIFICATION MEASURES (EM)
- EM’s are photos, palm prints, fingerprints, DNA samples and handwriting samples.
- Refuse these.
- EM may be made only with a written decision of prosecutors.
- If they order the measures, they may be implemented by force.
SUBSCRIPTION REFUSAL
Any signature can be refused. So you don’t have to sign anything. It’s best if you don’t sign anything.
TRANSLATION
You have the right in front of the police that everything is translated into a language which you can understand.
HAVE TO UNDRESS?
An intimate examination is only permitted if there is a concrete, objective suspicion that you are carrying a dangerous object, i.e. that this represents a danger to others or to yourself. Humiliating treatments are (actually) forbidden
AFTER REPRESSION…

- Protocol your memories of the action and repression.
- Take pictures of injuries by the police
- …and get a medical certificate as soon as possible
- Share your experience of repression with the collective.
- Ask for emotional support if you need it.
GENERAL TIPS
- Make sure that you don’t have anything with you that can be used to draw conclusions about yourself and others: Take only what you really need. Leave your agenda, address book and unnecessary keys at home. Best also the cell phone!
- Tear gas irritates even more with greasy creams, makeup and contact lenses. Spare lens and glasses are useful!
- Social media is not police safe
